2. Services Provided

Sun State Traffic Control specializes in traffic management solutions throughout Florida and South Georgia, including but not limited to:

  • Longitudinal channeling devices (LCD)
  • Rumble strips installation
  • Lane closure management
  • Professional flagging services
  • Traffic management for construction projects, roadwork, and special events

3. Service Agreements

3.1 Quotes and Proposals

All quotes provided are estimates based on the information supplied to us. Final pricing may be adjusted based on actual project requirements, site conditions, duration, or scope changes. Quotes are valid for 30 days from the date of issuance unless otherwise specified.

3.2 Service Contracts

Specific terms of service will be outlined in individual service contracts or work orders. In the event of any conflict between these Terms and a service contract, the service contract shall prevail.

3.3 Cancellations and Changes

Cancellations or significant changes to scheduled services must be provided in writing at least 48 hours in advance. Cancellations made with less than 48 hours notice may be subject to cancellation fees to cover mobilization costs and lost scheduling opportunities.

4. Client Responsibilities

Clients engaging our services agree to:

  • Provide accurate and complete information about the project site, requirements, and timeline
  • Obtain all necessary permits and approvals required for the project
  • Ensure safe access to the work site for our personnel and equipment
  • Notify us immediately of any changes to project scope, timeline, or site conditions
  • Provide adequate notice for any service modifications or cancellations
  • Ensure payment according to agreed-upon terms

5. Payment Terms

5.1 Payment Schedule

Payment terms will be specified in individual service contracts. Unless otherwise agreed, payment is due within 30 days of invoice date. We reserve the right to require deposits or advance payment for certain projects.

5.2 Late Payments

Accounts not paid within the agreed timeframe may be subject to late fees of 1.5% per month (18% annual percentage rate) or the maximum rate permitted by law, whichever is less. We reserve the right to suspend services for accounts in arrears.

5.3 Disputed Charges

Any disputes regarding invoices must be submitted in writing within 15 days of the invoice date. Undisputed portions of invoices remain due and payable.

6. Safety and Compliance

6.1 Industry Standards

Sun State Traffic Control maintains compliance with all applicable federal, state, and local regulations, including MUTCD (Manual on Uniform Traffic Control Devices) standards. Our staff are trained and certified in accordance with industry requirements.

6.2 Site Safety

While we implement comprehensive safety protocols for our operations, clients acknowledge that construction sites and traffic control areas inherently involve risks. All parties must adhere to posted safety signage and traffic control measures.

6.3 Third-Party Actions

We are not responsible for accidents, injuries, or damages caused by third parties who fail to follow traffic control measures, disregard signage, or otherwise act negligently in work zones under our management.

7. Limitation of Liability

7.1 Service Limitations

Our liability for any claims arising from our services shall be limited to the amount paid for the specific services giving rise to the claim. This limitation applies regardless of the form of action, whether in contract, tort, negligence, or otherwise.

7.2 Indirect Damages

In no event shall Sun State Traffic Control be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, even if we have been advised of the possibility of such damages.

7.3 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, severe weather, natural disasters, war, terrorism, labor disputes, government actions, or pandemic conditions.

8. Insurance and Indemnification

8.1 Insurance Coverage

Sun State Traffic Control maintains appropriate general liability and workers' compensation insurance. Certificates of insurance can be provided upon request for contracted projects.

8.2 Client Indemnification

Clients agree to indemnify and hold harmless Sun State Traffic Control from any claims, damages, or liabilities arising from: (a) inaccurate information provided by the client, (b) failure to obtain necessary permits or approvals, (c) unsafe site conditions not disclosed to us, or (d) client's breach of these Terms.

9. Intellectual Property

9.1 Website Content

All content on our website, including text, graphics, logos, images, and software, is the property of Sun State Traffic Control or its content suppliers and is protected by copyright and other intellectual property laws.

9.2 Traffic Control Plans

Traffic control plans and designs created by Sun State Traffic Control remain our intellectual property. Clients receive a license to use these plans solely for the specific project for which they were created. Unauthorized reproduction or use for other projects is prohibited without our written consent.

10. Privacy and Data Protection

Our collection and use of personal information is governed by our Privacy Policy. By using our services, you consent to our data practices as described in our Privacy Policy. We maintain the confidentiality of client information and project details except as required by law or authorized by the client.
